Pre-trial investigation established that officials of GP "Design Bureau "Artillery armament" (further - GP "CB" JSC, Kiev, USREOU code 34297075) appropriated funds of the State enterprise "Plant them. V. A. Malysheva" (hereinafter - SE "Winters", Kharkiv, Ukraine, USREOU code 14315629) in especially large sizes while supply last tank guns of 125 mm Soviet production (model 2A46M, on balance of GP "Kiev armoured plant", then KBTZ, Kyiv code EDRPOU 14302667) under the guise of new barrels production enterprise "KB "AO" (model KBA-3).
In particular, within the framework of the agreement dated 22.10.2015 No. 272/10-15, concluded between SE " zim "and SE" KB "AO", the latter during 2015-2016 carried out the supply of products (artillery systems and tank barrels) in accordance with the following specifications:
-KBA-3 artillery system assembled, 2 units, worth 2.25 million UAH. without VAT per unit, only UAH 5.4 million with VAT, until 10.11.2015 (specification No. 1);
-KBA-3 artillery system assembled, 2 units, worth 2.25 million UAH. without VAT per unit, only 5.4 million with VAT, until 31.03.2016 (specification No. 2);
- Pipe with casing KBA3-01.01.000, 2 units, worth 1 million UAH. without VAT per unit, only UAH 2.4 million with VAT, until 29.02.2016 (specification No. 3);
-KBA-3 artillery system assembled, 2 units, worth 2.25 million UAH. without VAT per unit, only UAH 5.4 million with VAT, until 29.02.2016 (specification No. 4);
-KBA-3 artillery system assembled, 1 unit, worth 2.25 million UAH. without VAT, and a pipe with a casing KBA3-01.01.000, 1 unit, worth 1 million UAH. without VAT, only UAH 3.9 million with VAT, until 30.04.2016 (specification No. 5);
- Pipe with casing KBA3-01.01.000, 1 unit, worth 1 million UAH. without VAT, only UAH 1.2 million with VAT, until 30.06.2016 (specification No. 6);

-KBA-3 artillery system assembled, 1 unit, worth 2.25 million UAH. without VAT, only UAH 2.7 million with VAT, until 30.11.2016 (specification No. 9).
According to the acceptance certificates of SE "KB "JSC" (No. 1 of 26.10.15, 2 of 28.11.15, 3 of 29.01.16, 4 of 15.02.16, 5 of 07.04.16, 6 of 03.06.16, 7 of 18.08.16 and 8 of 03.11.16) delivered products in accordance with the above specifications.
At the same time, in order to perform the aforementioned agreement, officials of GP "CB "AO", realizing the absence of technical possibility of manufacturing barrels, signed the contract with GP "KBTZ" from 22.09.2015 No. 057/247 for the purchase of guns and artillery systems, which were made during the Soviet era.
As established, in accordance with the expenditure invoices (No. 464 of 26.10.15, 534 of 27.11.15, 20 of 26.01.16, 57 of 12.02.2016, 122 of 25.03.16, 186 of 04.04.16, 303 of 01.06. 16 and 410 of 18.08.16), SE "KB "JSC received from SE" KBTZ "guns 2A46M and 2A46M1, which were implemented by SE" KB "JSC "to the address of the GP" zim", as the new KBA-3 models at a higher cost.
For the purpose of falsification of the specified transaction, officials of SE "KB "JSC made acts of acceptance and delivery of finished products (No. 2 of 28.01.16, 9a of 07.04.16, 21 of 03.06.16, 27 of 18.08.16, 3 of 12.02.16, 9 of 07.04.16, 68 of 09.10.15, 68a, 23.10.15, 72a of 27.11.15), according to which the specified trunks, allegedly, were made at SE" KB "JSC "shop No. 2 of metal brands 38KHN3MFA.
According to the testimony of the head of shop No. 2 (until November 2015), the head of shop No. 2 (from November 2015 to the present) and the head of the warehouse, tank barrels 2A46 at the enterprise were deconserved and defected. If necessary, work was carried out to remove rust and tint. After that, the trunks were canned and packed.
In the future, at the direction of the Acting General Director, the above-mentioned acts of finished products for the production of KBA-3 were drawn up. According to their testimony, the signatures affixed to the documents were forged.
These officials, as well as the chief accountant of the State Enterprise "KB "JSC, noted that the State Enterprise" KB "JSC "does not have the ability to produce KBA-3 tank guns, due to the lack of appropriate equipment.
Taking into account the above, officials of the State Enterprise " CB " JSC " sold products to the State Enterprise "zim" for a total amount of UAH 27.51 million. (With VAT), having spent reasonably only 12.59 million UAH.
In addition, the act on the results of the documentary planned field inspection of the State Enterprise "Design Bureau" Artillery Armament " dated 29.05.2018. №377/26-15-14-01-05/34297075 found that GP "CB "AO" was gratuitously received goods whose origin is not installed, because its purchase is not proven, but was used by SE "CB "AO" in the creation (fabrication, fault detection) artillery systems of KBA-S, which later were implemented at SE "Winters"in accordance with the Contract No. 272/10 - 15 from G. 22.10.2015
