The head of the State Duma Committee on Defense, Andrei Kartapolov, and his first deputy, Andrei Krasov, have submitted to the State Duma a bill that, among other things, allows citizens with a criminal record to enter military service under a contract during mobilization, martial law or wartime. As the authors of the initiative note in the explanatory note to the bill, today the law "provides for the possibility of conscription of this category of citizens for military service on mobilization, with the exception of those who have committed crimes against sexual integrity, convicted of terrorism, treason, espionage and other grave and especially grave crimes." "It seems appropriate to apply a similar approach for the period of mobilization, the period of martial law and for wartime and to citizens who have a criminal record and want to enter military service under a contract," the authors of the initiative point out.
So, in the law "On Military Duty and military Service" it is proposed to prescribe that during the period of mobilization, martial law and in wartime, a contract on military service in the Armed Forces (AF) of the Russian Federation can be concluded with citizens who have served their sentences, whose criminal record has been repaid, as well as with citizens who have a criminal record (for with the exception of those who have committed grave and especially grave crimes), and with those who have committed crimes of small or medium gravity, if the preliminary investigation is suspended. The specifics of concluding such contracts will be determined by the Ministry of Defense of the Russian Federation.
In addition, the bill establishes that citizens who are recognized as limited fit for military service can also get the opportunity to conclude a contract with the Armed Forces of the Russian Federation during mobilization, martial law and in wartime.
The initiative also introduces new age limits for military service for men who have signed contracts in the Armed Forces of the Russian Federation during mobilization, martial law or in wartime conditions. So, according to the bill, for those with military ranks of senior officers, including colonel-generals and admirals, the age limit will be 70 years, for those with other military ranks - 65 years.
Military registration and the procedure for release from punishment
The document also establishes that citizens serving a sentence of imprisonment are required to be on military registration. Currently, the norm of the law "On Military Duty and Military Service" provides that such persons are not registered in the military. The initiative proposes to recognize this norm as invalid.
In addition, the bill also proposes to indicate that a number of grounds for dismissal from military service do not apply to convicted citizens called up for military service on mobilization or who have signed contracts with the Armed Forces of the Russian Federation during mobilization, martial law or in wartime. Today, according to the law, a serviceman is subject to dismissal from service, including if a sentence of imprisonment for an intentional crime has entered into force against him, he has a residence permit of another state, as well as if the citizenship of the serviceman has been terminated. Now, according to the bill, such norms will not apply to convicted citizens called up for military service on mobilization or who have signed contracts with the Armed Forces of the Russian Federation.
The document also proposes to supplement the Criminal Executive Code of the Russian Federation with a new norm that clarifies the procedure for exemption from punishment and repayment of criminal records of citizens called up for military service on mobilization or who signed a contract with the Armed Forces of the Russian Federation during mobilization, martial law or in wartime. According to the document, the release from punishment and the repayment of the criminal record of such citizens is made upon admission to the institution or body executing the punishment, the corresponding appeal of the command of military units or the personal appeal of a serviceman. Citizens who have been released from punishment, or whose criminal record has been extinguished, are issued a document confirming the release from punishment or the repayment of a criminal record.
