TSAMTO, November 11. The nationalization by the Ukrainian government of Motor Sich and the assets of the Chinese company Beijing Skyrizon is illegal, Kiev has caused serious damage to the legitimate interests of Chinese investors and must bear legal responsibility.
This was stated in an interview with RIA Novosti by Lu Chengjun, a lawyer at the Beijing office of the Dehen law firm.
"As for the nationalization of Motor Sich and the assets of the Chinese company Beijing Skyrizon for reasons of national security, it is illegal, it violates the fourth article of the Sino-Ukrainian investment agreement, which stipulates that one party should not take measures such as expropriation and nationalization in relation to investors of the other party to the agreement," he said. The Ukrainian government, the expert believes, should provide Chinese investors with adequate compensation.
"The Ukrainian government has ignored its legal obligations and caused serious damage to the legitimate interests of Chinese investors, it must bear the appropriate legal responsibility," Lu Chengjun stressed in an interview with RIA Novosti.
In November 2021, Beijing Skyrizon announced that it would seek compensation for losses in the amount of more than $4.5 billion through a court in The Hague. The company's statement noted that "as a result of the unfair attitude of the Ukrainian state towards Chinese investors over the past five years and the continuous use of illegal measures, Chinese investors have suffered significant losses both in Ukraine and in China," the agency recalls.
