A group of deputies headed by the chairmen of the State Duma Committees on economic Policy and on Industry and Trade Maxim Topilin and Vladimir Gutenev submitted to the State Duma a package of bills concerning the specifics of calculations for the state defense order (GOZ) during the mobilization period. The documents are posted in the electronic database of the lower house of Parliament.
In accordance with the first draft law, the head executor, the executor of the State Budget is granted the right to use, during mobilization and during wartime, a single separate account opened under one of the state contracts or contracts for the state budget in an authorized bank for settlements under all state contracts or contracts for the state budget concluded by this head executor or executor. The head executor, the executor of the State Budget must notify the authorized bank of such a decision. When using a single separate account, all funds from other separate accounts that were previously opened and which are subject to closure due to the use of a single separate account are transferred to this account.
The provisions of the law "On the State Defense Order" regulating the use of a separate account are applied to a single separate account (an exception is if the execution of executive documents providing for the recovery of funds in favor of organizations that are the main executors, executors of the state defense order), as well as ensuring compliance with the requirement to use a separate account of each state contract. Corresponding norms are introduced into the law "On the State Defense Order", they have a reference character to the norms of legislation on mobilization training and mobilization.
"The implementation of the draft law is designed to optimize the time and financial costs of economic entities during the period of mobilization or wartime," the authors of the document indicate.
The second draft law amending the law "On Insolvency (Bankruptcy)" was developed taking into account the peculiarities of the current stage of development of the international situation under the sanctions regime and is aimed at regulating the specifics of the transfer of property complexes of organizations in respect of which bankruptcy proceedings have been opened to organizations performing state defense during mobilization and during wartime. This draft law establishes the procedure and conditions for the transfer of assets of enterprises under bankruptcy proceedings in bankruptcy proceedings to enterprises performing the State Budget.
The draft law establishes the right of the arbitration court conducting bankruptcy proceedings, within five days from the date of receipt of the decision of the Board of the Military-Industrial Commission of the Russian Federation (the Board of the Military-Industrial Complex), adopted during mobilization or during wartime, on the transfer of the debtor's property to the organization performing the GOZ, to make an immediately enforceable determination on suspension of bankruptcy proceedings in respect of the organization specified in the decision of the military-industrial complex board.
