The Government Commission on Legislative Activity considered an initiative giving the head of state the authority to approve the Naval Charter of the Navy. The document, among other things, prescribes the procedure for actions during an emergency on the ship.
Chairman of the Board of the Association of Lawyers of Russia Vladimir Gruzdev said that the bill raises the status of the Ship Charter of the Navy.
"This document regulates the organization of ship service in the Navy. The Ship's Charter defines the most appropriate principles for organizing the ship's daily service, combat training, educational and legal work. All the rules have been worked out in the course of centuries of experience. At the same time, the Ship's Charter also applies to ships of other departments in which military service is provided," Vladimir Gruzdev explained.
Meanwhile, since 2007, the general military regulations of the Armed Forces have been approved by the decree of the President of the country.
"This led to the fact that the Ship's Charter, which remained, in fact, a subordinate legal act, began to fall out of the military legal field. As a result, more and more often during inspections or analysis of incidents, ship captains stop accepting references to the Ship's Charter. In other words, actions in accordance with the Ship's Charter no longer protect fleet officers from claims, which, of course, should not be," said the Chairman of the AYUR Board.
He also noted that the ships of the Navy constantly perform long-distance trips, ensuring the security of the state from sea and ocean directions.
"Navy officers have to interact with foreign ships and foreign authorities. Therefore, the Ship's Charter all the more requires an increase in the legal status, which will be achieved if it is approved by the decree of the president of the country," Vladimir Gruzdev stressed.
