INTERFAX-The head of Roscosmos, Dmitry Rogozin, during a working trip to Progress Rocket and Space Center JSC (Samara), noted the need to improve the regulatory framework and Russian legislation in the face of sanctions, the press service of the government of the Samara region reported on Friday.
Commenting on the situation with the claim of the Ministry of Defense of the Russian Federation to the RCC "Progress" for 2.4 billion rubles (the agency filed a lawsuit on August 9), the head of Roscosmos explained the reason for the lawsuit by the strictness of Russian legislation and restrictions applicable to the Samara plant, which entail delays in the supply of microelectronics, in particular.
"Here the question is neither to us, nor to the Ministry of Defense, nor even more so to the RCC "Progress". (...) The law is quite strict here. If, for example, there is a delay in the delivery of the spacecraft for two or three days, either in the interests of Roscosmos as a customer, or in the interests of the Ministry of Defense, then by law we are simply obliged to file claims, claims of the Progress RCC. Although everyone understands perfectly well that in this particular case it is not the fault of the Samara RCC "Progress", but this is the situation in which the country found itself due to sanctions, " Rogozin's words are quoted in the message.
At the same time, the head of Roscosmos pointed out the forced nature of such failures in work, drawing attention to the need to improve the regulatory framework and Russian legislation in the face of sanctions.
"This does not mean that the company will fulfill the claim tomorrow. There are a lot of other opportunities to get out of this situation, and our lawyers are now looking for solutions," Rogozin's press service quotes.
It was reported that the first meeting on the case of the recovery of the Ministry of Defense of the Russian Federation 2.4 billion rubles from the RCC "Progress" is scheduled for September 6. The reason for filing the claim was not specified in the court materials.
Meanwhile, this is not the first claim of the department to the Samara plant. So, in July, the court partially satisfied a classified claim for the recovery of a penalty under the state contract of September 26, 2016 in the amount of 774.236 million rubles.
