At the meeting, the Federation Council approved a law on extending the rule on deferral from conscription to employees in the bodies and organizations of the Prosecutor's Office of the Russian Federation, as well as in investigative bodies and institutions of the Investigative Committee of the Russian Federation.
The law "On Military Duty and Military Service" is supplemented by the norm on deferral from conscription, including for citizens who joined the bodies and organizations of the Prosecutor's Office of the Russian Federation, investigative bodies and institutions of the IC of the Russian Federation immediately after receiving the appropriate higher education. According to the document, a deferral will be provided to citizens with higher education and special appeals for the duration of such service. According to current norms, deferral from conscription is granted to employees in the internal affairs bodies, the State Fire Service, institutions and bodies of the penal enforcement system, enforcement agencies and customs authorities of the Russian Federation if they have higher education and special ranks.
The document also extends the provisions of the law on exemption from military duties to citizens serving in the bodies and organizations of the Prosecutor's Office of the Russian Federation, as well as in investigative bodies and institutions of the IC of the Russian Federation, in positions providing for the assignment of special titles or class ranks. It is also indicated that a military serviceman under a contract may be prematurely discharged from military service in connection with the transition to service in the bodies and organizations of the Prosecutor's Office of the Russian Federation, as well as in investigative bodies and institutions of the IC of the Russian Federation.
In addition, such employees, as well as customs officers, are placed on special military registration, the procedure and features of which will be determined by the Cabinet of Ministers of the Russian Federation. The relevant norms already apply to citizens serving in the Department of Internal Affairs, Rosgvardiya, FSSP, the State Fire Service, institutions and bodies of the Federal Penitentiary Service in the positions of ordinary and commanding staff.
Staying in reserve
The document also expands the possibilities for concluding a contract on staying in the mobilization human reserve. The relevant amendments were supported by the relevant State Duma Committee on Defense during the work on the draft law for the second reading. According to current regulations, a contract on staying in the reserve can be concluded by citizens of the Russian Federation who do not have foreign citizenship or residence permit, who are in the reserve and have completed military service or completed military training programs.
The new rules establish that citizens who do not have foreign citizenship, who are in the reserve, and who previously stayed in volunteer formations in accordance with the law "On Defense" will also have the opportunity to conclude a contract on staying in the reserve. In addition, employees of the Rosgvardiya, the State Fire Service, the Ministry of Internal Affairs, the FSSP, customs authorities of the Russian Federation, bodies and organizations of the Prosecutor's Office of the Russian Federation, as well as investigative bodies and institutions of the IC and institutions and bodies of the penal enforcement system will have the right to conclude a contract on staying in the mobilization reserve. We are talking about employees who have not completed military service, but have special titles and are enrolled in the reserve.
Such citizens are also subject to the current regulations on the age limit for staying in the reserve. So, if such citizens have military ranks of senior officers, they will be able to sign a contract at the age of 62, junior officers will be able to sign the first contract for staying in the reserve at the age of 57, and citizens with other military ranks - up to 52 years. Citizens with military ranks of senior officers will be able to conclude such a contract at the age of 67.
It is established that in case of admission to military service, military ranks to employees of the Rosgvardiya, the State Fire Service, the Ministry of Internal Affairs, the FSSP, customs authorities of the Russian Federation, bodies and organizations of the Prosecutor's Office of the Russian Federation, as well as investigative bodies and institutions of the IC of the Russian Federation and institutions and bodies of the penal enforcement system with special titles will be assigned according to the regulations on the procedure for passing military service approved by the decree of the President of the Russian Federation. At the same time, the law is supplemented by the norm that the appointment of a citizen to the post of judge will be the basis for his exclusion from the mobilization human reserve.
The law will come into force on September 1, 2024.
