The State Duma Committee on Property, Land and Property Relations recommended that the lower house of parliament adopt in the first reading a bill on the application of concession agreements and public-private partnership (PPP) agreements in the field of space activities. The document was initiated by Senators Andrey Kutepov and Murat Khapsirokov.
In particular, it is proposed to amend the laws "On Concession Agreements" and "On Public-private Partnership, municipal-private Partnership in the Russian Federation". "Space infrastructure facilities that are federal property (with the exception of dual-use and military space infrastructure facilities) may be transferred to a person who is a concessionaire under a concession agreement or a private partner under a public-private partnership agreement," the text of the bill states.
The draft law introduces the concept of a "space object" and proposes to empower the Roscosmos state corporation to conclude concession agreements and PPP agreements on behalf of the Russian Federation in relation to space objects.
The draft law empowers Roscosmos State Corporation to conclude concession agreements and PPP agreements on behalf of the Russian Federation in relation to space infrastructure facilities, as well as to exercise the powers of the concedent, a public partner under such agreements, if there is a corresponding decision of the Government of the Russian Federation to conclude a concession agreement on the implementation of a PPP project.
"As a result of the adoption of the bill, it is expected to solve the tasks of attracting investments in the development of the Russian space industry, increasing the share of participation of Russian private companies in the global space market. In addition, the adoption of the bill will provide an opportunity for the Russian Federation to create a full-fledged orbital constellation of spacecraft capable, among other things, of solving the tasks of operational monitoring of the Arctic zone," the explanatory note says.
The project will attract private companies to the space sector
According to the chairman of the committee, Sergei Gavrilov (Communist Party of the Russian Federation), the bill deserves attention. "One of the fundamentally important components of the state policy in the field of using the results of space activities in the interests of economic modernization is the development of public-private partnership in the space industry. With the help of PPP, it will be possible to create favorable conditions for attracting private companies to the space sector. Roscosmos State Corporation will be able to conclude concession agreements and PPP agreements on behalf of the Russian Federation," explained Sergey Gavrilov. - In the course of work on PPP legislation, we are expanding the scope of application of already proven and proven mechanisms for attracting non-state funds for the modernization of economic sectors. We have already proposed such changes in the field of information technology, heat and water supply facilities, and we think that a similar practice is applicable in the space industry."
