The State Duma has tightened responsibility for violating the requirements of military registration

In particular, the State Duma adopted an amendment on fines of up to 30 thousand rubles for failure to appear on a summons to the military enlistment office

MOSCOW, July 25. /tass/. The State Duma adopted immediately in the second and third readings a bill on toughening responsibility for violating the requirements of military registration, which, among other things, provides for an increase to 30 thousand rubles in the fine for failure to appear on the summons to the military enlistment office.

The document was submitted to the House of Parliament on February 1, 2019 by a group of deputies headed by the first deputy chairman of the Duma Defense Committee Andrei Krasov and adopted in the first reading on March 17, 2021.

Initially, it was proposed to increase fines under the articles of the Administrative Code contained in Chapter 21 (administrative offenses in the field of military registration), including non-fulfillment of military registration duties by citizens, evasion of medical examination and intentional damage or loss of military registration documents were to be punished with a fine of up to 5 thousand rubles.

Content of amendments

In the second reading, parliamentarians significantly revised the bill. Thus, a new article will appear in the Code of Administrative Offenses of the Russian Federation, according to which fines are introduced for failure to fulfill the obligation to ensure timely notification and appearance of citizens subject to conscription for military service on mobilization, to assembly points or military units, failure to assist in organizing such notifications and appearances. For officials, fines will range from 60 thousand to 80 thousand rubles, for legal entities - from 400 thousand to 500 thousand rubles. Similar penalties are provided in the new article for failure to fulfill the obligation to organize or ensure the delivery of equipment to assembly points or military units in accordance with mobilization plans.

In Article 21.1 of the Administrative Code of the Russian Federation, it is proposed to prescribe new fines for failure to submit lists of citizens to the military enlistment office, subject to initial military registration. Punishment is provided for officials from 40 thousand to 50 thousand rubles, for legal entities - from 350 thousand to 400 thousand rubles. Now for such a violation, the fine is from 1 thousand to 3 thousand rubles.

Similar fines are introduced in Article 21.2 of the Administrative Code of the Russian Federation for non-notification of citizens about the summons (summons) of the military commissariat or other body carrying out military registration, upon receipt of such calls (summons) from military commissariats (including in electronic form), as well as for failure to provide citizens with the possibility of timely appearance on the summons (summons) of the military commissariat or another body carrying out military registration. Now this article provides for liability for non-notification by the head or other official of the organization, as well as by an official of the local self-government body responsible for military accounting work, of citizens about calling them on the agenda of the military commissariat or other body carrying out military registration, as well as failure to provide citizens with the possibility of timely appearance on the call on the agenda of the military commissariat or other the body that carries out military registration. The penalty for such a violation is from 1 thousand to 3 thousand rubles.

The amendments amended the wording of Article 21.4. of the Administrative Code. Now it provides for sanctions for failure to report information about citizens who are or are required to be on military registration. According to the adopted amendments, fines from 40 thousand to 50 thousand rubles are established for failure or untimely submission by officials of state bodies or organizations of information necessary for maintaining military records.

New fines for citizens

Fines under Article 21.5 of the Administrative Code of the Russian Federation (non-fulfillment of military registration duties by citizens) are also increasing many times. So the fine for non-appearance of citizens without a valid reason at the time and place indicated in the agenda of the military commissariat or on the call of another body carrying out military registration will be from 10 thousand to 30 thousand rubles (now from 500 to 3 thousand rubles).

The fine for failure by a citizen to report in accordance with the established procedure to the military commissariat or the body carrying out primary military registration, about a change in marital status, education, place of work (study) or position, information about moving to a new place of residence, not confirmed by registration, will be from 1 thousand to 5 thousand rubles.

For failure by a citizen to report to the military commissariat or to the body carrying out primary military registration, information about leaving Russia for a period of more than six months or entering the country, as well as for failure to appear at the military commissariat within the period established by federal law, a fine of 5 thousand to 15 thousand rubles is provided.

A fine of 10 thousand to 20 thousand rubles is provided for failure to report to the military commissariat or to the body carrying out primary military registration, by a citizen subject to conscription, information about departure during the conscription period for a period of more than three months from the place of residence or place of stay, including those not confirmed by registration at the place of residence and (or) the place of stay.

Fines are also changed in Article 21.6 of the Administrative Code of the Russian Federation (evasion of medical examination). Now, for evading a medical examination or examination in the direction of the commission for the registration of citizens for military registration, as well as from a medical examination in the direction of the draft commission, a warning or the imposition of an administrative fine in the amount of 500 to 3 thousand rubles is provided. The adopted amendments set the fine in the amount of 15 thousand to 25 thousand rubles.

Article 21.7 of the Administrative Code of the Russian Federation increases the penalty for intentional damage or loss of military registration documents. It will be from 3 thousand to 5 thousand rubles (now from 500 to 3 thousand rubles).
