INTERFAX - The State Duma on Wednesday adopted in the third and final reading a law on the right of the government of the Russian Federation to introduce special measures in the economic sphere in order to ensure that the Armed Forces of the Russian Federation, other troops, military formations and bodies conduct counter-terrorism and other operations outside the territory of the Russian Federation.
The law provides that special measures may, among other things, provide for: carrying out activities carried out by federal executive authorities, executive authorities of constituent entities of the Russian Federation, local self-government bodies and organizations, the procedure for their financing and logistical support.
In addition, such measures include the temporary deconservation of mobilization capacities and facilities; the dismantling of material assets of the state reserve, as indicated in the law.
Also among the special measures is the establishment of the specifics of the legal regulation of labor relations in individual organizations, their structural divisions and at individual production facilities, including the procedure and conditions for engaging in work outside the established working hours, at night, on weekends and non-working holidays, the provision of annual paid vacations.
According to the law, if the Government of the Russian Federation decides to introduce special measures, legal entities, regardless of their organizational and legal form and form of ownership, are not entitled to refuse to conclude contracts, state contracts (contracts) for the supply of goods, performance of works, provision of services in order to ensure the conduct of counter-terrorism and other operations outside the territory of the Russian Federation, The Armed Forces of the Russian Federation, other troops, military formations and bodies.
This applies to contracts concluded in accordance with Laws No. 223-FE "On Procurement of goods, Works, services by Certain Types of Legal Entities", No. 275-FZ "On the State Defense Order" and (or) No. 44-FZ "On the contract system in the field of procurement of goods, works, services to Ensure state and municipal needs".
In addition, in order to shorten the terms of concluding state contracts and contracts for the state budget, the draft law provides, if the government of the Russian Federation decides to introduce special measures in the field of economics, the purchase from a single supplier (contractor, contractor) by certain types of legal entities of products necessary for the implementation of the state budget, as well as for the formation of its stock in accordance with federal law "About the state defense order".
It also provides for an increase or decrease at the suggestion of individual state customers (the Ministry of Emergency Situations of Russia, the Ministry of Defense of Russia, the FSB of Russia and Rosgvardiya) within the indicators of the State Budget for the corresponding period provided for by the state contract concluded under the State Budget, the quantity of goods, the amount of work or services.
The adoption of the law will not require the allocation of additional allocations from the federal budget, as well as the budgets of the constituent entities of the Russian Federation, the law says.
The explanatory note notes that "in the conditions of counter-terrorist and other operations carried out by the Armed Forces of the Russian Federation, other troops, military formations and bodies outside the territory of the Russian Federation and, in particular, a special military operation in the territories of the Donetsk People's Republic, the Luhansk People's Republic and Ukraine, there is a short-term increased need for the repair of weapons and military equipment and material and technical means".
In addition, it is noted that the need to promptly meet these needs, especially in the context of the introduction by foreign states and international organizations of restrictive measures against citizens of the Russian Federation and Russian legal entities, will require temporarily focusing efforts in certain sectors of the economy (in certain areas), reloading the production capacities of organizations of the military-industrial complex, including mobilization, and to organize the supply of resources within the framework of the state defense order.
