The mechanism for blocking websites with the data of persons under state protection is presented in the draft government decree. The document was developed by the Ministry of Internal Affairs of Russia and published on the Federal Portal of Draft regulatory Legal Acts.
How will such a blockage occur? Recall that on July 1, 2021, a law came into force that grants Roskomnadzor new powers to impose a ban on the dissemination of information. The reason for the inclusion of resources in the Unified Register of Prohibited Sites was the availability of information about persons under state protection who are provided with confidentiality.
Roskomnadzor, within a day from the date of receipt of the decision to recognize the information as prohibited and the decision to restrict access to it, will have to make an appropriate registry entry in the register. It contains the domain name and the index of the website page on the Internet, a description of the identified prohibited information that allows it to be identified, information about the decision taken by the authorized body, the date and time of receipt of the prohibited information.
Information about the hosting provider or the owner of the site is also entered in the registry. At the same time, the registry entries of the unified register should not contain indications of the personal data of the protected person. The only exception is the domain name and the index of the website page on the Internet and the description of the identified prohibited information. The reverse procedure is also provided for the exclusion of the site from the Unified Register of Prohibited Sites and the removal of blocking from it.
State protection is provided to judges, prosecutors, employees of the FSB and the IC of Russia, the penal enforcement system, enforcement agencies, the Ministry of Internal Affairs, certain servicemen of the Rosgvardiya, the Ministry of Defense and the Foreign Intelligence Service. The list of persons to whom such a security measure as ensuring confidentiality will be applied is determined by the head of the relevant structure. The law, which came into force last summer, included in the list of new persons who are entitled to state protection. Now they are all employees of the Ministry of Internal Affairs, Rosgvardiya, Ministry of Defense and SVR.
Previously, protection was provided only to those employees who were involved in operational search and investigative activities, in the protection of public order and the execution of court sentences, or those who directly participated in the fight against armed crime or terrorism, as well as in special operations. State protection also began to be provided to those already dismissed from service in the Ministry of Internal Affairs, Rosgvardiya, FSB and state security bodies, provided that "there is a continuing threat of encroachment on life, health and property", Rosgvardiya can be involved in their protection.
