Moscow. November 8th. INTERFAX - The Arbitration Court of the Moscow District on Monday upheld the decision of lower courts to recover 461.8 million rubles of debt from Sistemprom in favor of the Ministry of Defense of the Russian Federation out of the required 761.8 million rubles.
As follows from the court's file, the court rejected the complaints of the parties.
The case file says that the Ninth Arbitration Court of Appeal on July 8 confirmed the decision of the Moscow Arbitration Court, which on April 15 decided to recover 461.8 million rubles of debt from Sistemprom in favor of the Russian Defense Ministry.
The Court of First Instance also terminated the state contract concluded by the parties on May 16, 2011.
The lawsuit was filed for the termination of the contract, as well as the recovery of an unprocessed advance in the amount of 461.8 million rubles and 300 million rubles of interest.
The contract was signed for the implementation of experimental design work "Hitch-Broiler" for the needs of the department in 2011.
The Ministry of Defense indicated that it had transferred almost 2 billion rubles to Sistemprom. The contractor performed works in the amount of 1.5 billion rubles.
The agency believes that the contractor has a debt to him in the form of an unprocessed advance in the amount of 461.8 million rubles. The amount of interest for the use of other people's funds according to the calculation of the plaintiff is almost 300 million rubles.
The court, having studied the case materials, partially satisfied the claim, collecting only the unprocessed advance.
Sistemprom is engaged in scientific research and development in the field of natural and technical sciences.
The Arbitration Court of Moscow on April 22 recognized the application of JSC Concern Sistemprom on its own bankruptcy as justified. The court then introduced a monitoring procedure against the company and approved Dmitry Filatov as interim manager.
