Moscow. October 30. INTERFAX - Chairman of the Government of the Russian Federation Mikhail Mishustin signed a resolution of the Cabinet of Ministers approving the rules for maintaining the Register of Intellectual Property results directly related to defense and security. The text of the resolution, which will come into force on January 1, 2022, was published on Saturday on the official portal of legal information.
The Rules establish the procedure for maintaining a register of the results of intellectual activity directly related to the provision of defense and security. The objects of registration in the register are production secrets (know-how) directly related to the provision of defense and security (production secrets) obtained within the framework of state programs or in the implementation of the state Budget, the implementation of which is provided by the Ministry of Defense, as well as being the own developments of the authorized body or state institutions subordinate to it.
The register is maintained by the authorized body on electronic or electronic and paper media (by decision of the authorized body) in compliance with the requirements of the legislation of the Russian Federation on the protection of state and other legally protected secrets and protection from unfair competition.
Information on production secrets is entered into the register within 30 days from the date of the decision of the authorized body on the legal protection of information as a production secret; notification of the authorized body by the institution subordinate to it on the decision on the legal protection of information as a production secret.
When entering into the register, each production secret is assigned a unique registry number.
The registry consists of the following sections:
a) section I - the name of the secret of production, a brief description and the date of occurrence of the secret of production;
b) section P - type (category) of information to which the secret of production belongs;
c) section III information on the establishment of a confidentiality regime in relation to the secret of production of information;
d) section IV information about the object of equipment, technology, planned use of the secret of production;
e) section V information on the grounds of the exclusive right to the secret of production (its rightholder);
(e) Section VI - Information on the source of funding;
g) section VII - information on the disposal of the exclusive right to the secret of production or on the termination of its legal protection with an indication of the date.
If false information about the secret of production is detected in the register, the relevant information is changed by the authorized body within 15 days from the date of detection by making changes to the relevant section.
Technical errors in the information entered in the register are corrected by the authorized body within 15 days from the date of detection.
